§ 1
General Provisions
- These regulations specify the manner of providing services by electronic means and the rules for concluding and implementing contracts concluded via the website www.seaweed.pl, which is owned by Karol Majewski, conducting business activity under the name Karol Majewski Zest Creations NIP: 7311954225, REGON: 101380881, address of conducting activity and delivery address: ul. Julianowska 1 lok 94, 91-473 Łódź, e-mail address [email protected] and addresses and contact numbers indicated on the Website in the “Contact” tab.
- In matters not covered by the regulations, applicable law shall apply.
In the scope of services provided electronically, these regulations are the regulations referred to in art. 8 of the Act on the provision of electronic services (Journal of Laws 2017.1219, i.e. of 2017.06.24, as amended)
§ 2
The terms used in the Regulations mean:
- Regulations – these regulations.
- Website – the website available at www.seaweed.pl
- Seller – Karol Majewski operating under the business name Karol Majewski Zest Creations, NIP: 7311954225, REGON: 101380881, business address and delivery address: ul. Julianowska 1 lok 94, 91-473 Łódź, e-mail address [email protected] and addresses and contact numbers indicated on the Website in the “Contact” tab.
- Client – a natural person, legal person or organizational unit without legal personality, whose law grants legal capacity, concluding a sales contract via the website.
- Consumer – a Customer who is a natural person concluding a contract with the Seller for a purpose not related directly to his business or professional activity.
- Product – a movable item available on the website that is the subject of a sales contract between the Customer and the Seller. All offered products are brand new and meet the requirements of European and Polish law.
- Contract – a contract for the sale of products concluded remotely between the Seller and the Customer, via the Website.
Electronic service – a service provided electronically by the Seller, which takes place without the simultaneous presence of the Seller and the Customer. - Newsletter – an electronic service consisting in receiving information about promotions and news sent by the Seller.
- Price – determining the amount for which the Customer can buy products offered on the website. The prices are given in Polish zlotys and include VAT. The price does not include delivery costs.
- Business day – it is a day from Monday to Friday.
- Order form – a form available on the website that allows placing an order, which leads to the conclusion of a sales contract
- Rebate code – a code entitling its holder to receive a one-time price reduction. The amount of the price reduction and the period of validity of the code is established by the Seller upon its issuing.
§ 3
Conditions for the provision of electronic services
- Technical requirements necessary to use the electronic service provided by the Seller:
- device with internet access (computer, tablet, smartphone),
- web browser supporting cookies and java script,
access to email.
§ 4
Types and scope of electronic services
- The seller allows the use of the following electronic services:
- order form,
- accounts on the website,
- newsletter.
- The seller provides an order form that allows you to order products available on the website.
- In order to use the order form:
- enter the website,
- select the product on offer that is to be the subject of the contract,
- put it in the basket by pressing the “Buy now” selection button,
- after selecting all the necessary products go to the “Basket”,
- choose the type of shipment and press the “Go to checkout” selection button,
- complete the order form and choose the payment method,
accept the regulations, - continue by clicking the “Buy and pay” button.
- To set up an account on the website:
- enter the website,
- select the product on offer that is to be the subject of the contract,
- put it in the basket by pressing the “Buy now” selection button
- after selecting all the products you need, go to the “Basket”
- choose the type of shipment and click “Go to checkout”
- complete the order form and choose the payment method,
- select the “Create account?”
- accept the regulations,
- continue using the “Buy and pay” button.
- In order to subscribe to the newsletter you should:
- enter the website,
- select the product on offer that is to be the subject of the contract,
- put it in the basket by pressing the “Buy now” selection button,
- after selecting all the necessary products go to the “Basket”,
- choose the type of shipment and click the “Go to checkout” selection button,
- complete the order form and choose the payment method,
- select the “I want to receive news and promotions by e-mail (optional)” button
- accept the regulations,
- continue using the “Buy and pay” button.
- Each of the electronic services is provided by the Seller free of charge.
- Contract for the provision of electronic services:
- the order form is concluded for the duration of its use and is terminated when the order is placed,
- the account on the website is concluded when the account is created for an indefinite period and is terminated after the Customer sends a request to delete the account on the website,
- The newsletter is concluded as soon as you agree to receive messages for an indefinite period and terminates after sending the Customer’s request to remove him from this service.
- In the event of a breach of the provisions of these Regulations, the Seller, after prior unsuccessful call to stop the violations with an appropriate deadline, may terminate the contract for the provision of electronic services immediately.
§ 5
Complaints about electronic services
- The Seller undertakes actions to ensure the fully correct operation of the website and undertakes to remove immediately any irregularities.
- Irregularities related to the functioning of the website may be reported by the Customer to the following address: [email protected]
- In the complaint, the Customer should provide his name and surname, correspondence address, and indicate the type and date of irregularity related to the provided electronic service
- The Seller undertakes to consider the complaint within 14 business days and if it was not possible, to inform the Customer within this period when the complaint will be considered.
§ 6
Conclusion of the contract and its implementation
- In order to conclude a contract via the website:
- enter the website,
- select the product on offer that is to be the subject of the contract,
- put it in the basket by pressing the “Buy now” selection button,
- after selecting all the necessary products go to the “Basket”,
- choose the type of shipment and click the “Go to checkout” selection button,
- complete the order form or place an order via a previously
- created account on the website and choose the payment method,
- accept the regulations,
- continue using the “Buy and pay” button.
- The implementation of the activities referred to in paragraph 1 constitutes a declaration of will to conclude a contract with the Seller.
- The Seller confirms the conclusion of the contract by sending an e-mail to the address provided, which contains a summary of the products that are the subject of the contract.
- The contract is considered concluded when the Customer receives the e-mail message referred to above.
§ 7
Shippment
- Deliveries of products bought on the website are carried out only within the territory of the Republic of Poland.
- Purchased products are delivered in accordance with the will of the customer through the selected delivery method that can be selected when placing the order.
- The cost of delivery is indicated when choosing the delivery method.
- The delivery should be made immediately, but no later than 14 business days from the conclusion of the contract.
- In the event of any damage to products that may be associated with delivery, in order to improve the complaint procedure, it is recommended that they be reported within 24 hours of receipt of the parcel to the address [email protected] and within 7 days to the courier company or other entity that made the delivery .
- In the case of one order consisting of many products, which differ in the way they are packaged, in particular due to their size or differences in the time of order processing, the Seller may divide the order into smaller shipments. In the situation described, the delivery cost provided to the Customer in the order summary does not change, but is divided into individual shipments. In the event that a part of the order is canceled – regardless of the reasons, only the delivery costs that have been assigned to the canceled part of the order shall be corrected and refundable.
§ 8
Complaints about product defects
- The seller is obliged to provide the product free from defects.
- If the product has a defect, the legal basis for considering complaints are in particular the provisions of Art. 556-576 of the Act of April 23, 1964, Civil Code (Journal of Laws 2018.1025, i.e. of 2018.05.29, as amended).
- Complaints should be submitted to the address [email protected] or to the address of the Seller’s registered office.
- When submitting a complaint, please describe the product defect.
- The product should be sent with a description of the product defect to the address of the Seller.
- The previous sentence does not apply to cases in which sending the product is unnecessary to clarify the matter, and the Customer only requests a price reduction, if he is entitled to such a right.
- However, the Customer is obliged to send the product to the Seller’s address indicated in § 1 paragraph 1 of the Regulations, if the Seller deems it necessary to consider the complaint.
- The Seller shall, at the latest within 14 calendar days from the date of receipt of the complaint, respond to the complaint and inform the Customer about further proceedings.
- In the event that the complaint is justified, the Seller will inform the Customer about the proposed way of handling the complaint. If the Buyer demanded replacement of the item or removal of the defect, or made a statement on the price reduction, specifying the amount by which the price is to be reduced, and the Seller did not respond to this request within 14 days, it is considered that the request was justified.
- The seller gives no warranty for products and does not provide after-sales services.
§ 9
Withdrawal from the contract
- Based on Article. 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2017, item 683, as amended). A consumer who has concluded a contract may withdraw from it within 14 days without giving a reason.
- The right to withdraw from the contract is not entitled to the Consumer in relation to products that have traces of use, and in particular if the products have the protective film (soaps) or the protective blend removed (body scrubs or butter) or are damaged (accessories and books).
- To exercise the right of withdrawal, the Customer should inform the Seller about his decision to withdraw from the contract within the time limit indicated in point 1 of this paragraph.
- The Customer may use the model withdrawal form provided by the Seller.
- Withdrawal from the contract may apply to all products covered by a given order or parts thereof. In the event of withdrawal from the contract of a product purchased in a set with another product, the entire set is refundable.
- The Seller provides the opportunity to submit a statement of withdrawal from the contract electronically by sending a scan of the statement to the e-mail address: [email protected] or by post to the address Karol Majewski Zest Creations, ul. Włodarzewska 81/22, 02-393 Warsaw.
- In the event of withdrawal from the contract, the contract is considered void.
- The product should be sent to the following address: Karol Majewski Włodarzewska 81/22, 02-383 Warsaw.
The costs of returning the product to the Seller in connection with the withdrawal from the contract without giving a reason shall be borne by the Customer. - The seller refunds using the same payment method that the customer used.
§ 10
Out-of-court complaint settlement and redress methods
The consumer has the following options in particular
out-of-court complaint consideration and redress methods:
- has the right to apply to a permanent amicable consumer court operating at the Trade Inspection to resolve the dispute arising from the concluded contract,
- is entitled to ask the provincial inspector of the Trade Inspection to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller,
- may obtain free assistance in resolving the dispute between the Consumer and the Seller, also using the free assistance of the poviat (municipal) consumer ombudsman or social organization, whose statutory tasks include consumer protection.

§ 11
Personal data protection
Final Provisions
- The Seller reserves the right to make changes to the regulations.
- In the event of changes to the regulations, the Customer will be informed about them via the website at least 7 days in advance.
